Our Commitment to the Use of Copyright Materials

Policy Statement

  1. The International Centre for Children and Family Law is a company registered in Australia. ICCFL is committed to respecting the efforts of authors and researchers and disseminating information is a fair and respectful way. Therefore, ICCFL has joined the Australian Copyright Agency (The ACA).
  2. This membership allows ICCFL to provide copies of Copyright Materials to students by the following means:
    1. Hard copies provided in training programs or by delivered by a postal/delivery service.
    2. Digital/Electronic Copies provided by download from a secure student portal, or by email to individual students or classes.
  3. It is a requirement of this licence that all students do not make additional copies of copyrighted hard copies or give electronic access to people who are not students of ICCFL studying in the same course. Undertaking such an action not only places ICCFL in breach of its copyright obligation, but also exposes the student to the possibility of a breach of Copyright Action against them.
  4. Students who act in breach of this policy may have their access to the learning portal suspended without refund of course fees.

Hard Copies of Copyright Works

  1. ICCFL can make the following Hard Copies within its licence from The ACA:

A. Books and other separately published works

In respect of a literary, dramatic or musical work contained in a published edition of that work, being an edition of more than 10 pages in length, a reasonable portion may be copied which means the greater of:

a. 10% of the number of pages in that edition; or
b. one chapter of that edition.

This does not apply to the copying of an article in a periodical publication.

B. Periodical publications

a. the whole or part of an article contained in any issue of a periodical publication; or
b. the whole or part of two or more articles contained in any issue of a periodical publication if those articles relate to the same subject matter.

C. Anthologies

The whole or part of a literary or dramatic work in a published anthology of works if that work comprises not more than 15 pages of that anthology.

D. Artistic works

An artistic work may be copied in whole or part if:

a. that artistic work accompanies a literary or dramatic work for the purpose of explaining or illustrating the literary or dramatic work copied (and the literary or dramatic work has been copied within these limits); or
b. it is not separately published.

If an artistic work has been separately published, no more than a reasonable portion of that work can be copied unless a new copy of the artistic work cannot be obtained within a reasonable time at an ordinary commercial price.

E. Works not separately published

The whole or part of a literary, dramatic, musical or artistic work (other than an article in a periodical publication) which is not separately published.

F. Unavailable works

The whole or part of a literary, dramatic, musical or artistic work (other than an article in a periodical publication) if a new copy of that work cannot be obtained within a reasonable time at an ordinary commercial price.

Digital Copies of Copyright Works

  1. ICCFL can make the following Digital/Electronic Copies within its licence from The ACA:

A. Literary and dramatic works

a. 10% of number of words;
b. the whole work if not published or published on its own; and
c. the whole work if not available within a reasonable period of time at an ordinary commercial price.

B. Periodical publications

a. one article per issue or more if the same subject matter.

C. Musical works

a. 10%;
b. the whole work if not published or published on its own; and
c. the whole work if not available within a reasonable period of time.

D. Artistic works

a. all of an artistic work.
